Terms of Use
These Terms of Use ("Terms") are an agreement between you and Appenstance, LLC, a Wyoming limited liability company ("we", "us"), which operates the Uncan app ("Uncan"). By creating an account or using Uncan, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use Uncan.
1. What Uncan is
Uncan helps you track nicotine pouch use, count the money you keep, and quit or taper on your own terms. It includes check-ins, days-clean and money-saved counters, streaks, a taper mode, a craving SOS feature and Dex, an AI coach.
Uncan is not medical advice. It isn't a medical device, a medical service or a smoking-cessation treatment, and it makes no claims about health outcomes or about helping you quit. Talk to a doctor or pharmacist about anything health-related, including withdrawal or nicotine replacement products. In an emergency, contact local emergency services. In the US you can call or text 988 for crisis support.
2. Who can use it
You must be at least 17 years old and legally allowed to buy nicotine products where you live. By using Uncan, you confirm that you meet these requirements.
3. Your account
You sign in with email or with Sign in with Apple, through our provider Clerk. Keep your sign-in secure, and tell us if you think someone else has accessed your account. You're responsible for activity on your account. You can delete your account at any time in the app under Settings > Delete account.
4. Subscriptions
- Uncan requires a paid subscription: $8.99 per month or $49.99 per year (US prices; prices in other regions may differ and are shown in the App Store before you buy).
- Payment is charged to your Apple ID account when you confirm the purchase. Subscriptions are sold through Apple in-app purchase and managed by RevenueCat.
- Your subscription renews automatically unless you cancel at least 24 hours before the end of the current period. Your account is charged for the renewal within 24 hours before the current period ends, at the then-current price.
- To cancel, go to iOS Settings > [your name] (Apple ID) > Subscriptions > Uncan. Cancelling stops future renewals, and you keep access until the end of the period you've paid for. Deleting the app or your Uncan account does not cancel your subscription.
- If an offer includes a free trial, any unused part of it ends when you buy a subscription.
- Refunds are handled by Apple under Apple's policies. Request one at reportaproblem.apple.com.
5. Dex, the AI coach
Dex is an AI coach powered by Cloudflare Workers AI, a third-party AI service. You must agree before your first chat. Dex can be wrong, incomplete or inappropriate. Its replies aren't professional, medical, psychological or legal advice, and you shouldn't rely on them for decisions about your health or safety. Dex messages have hourly and daily limits. How we handle Dex messages is described in the Privacy Policy.
6. Acceptable use
Don't misuse Uncan. That means don't try to access other people's data or our systems without permission, interfere with or overload the service, reverse engineer it except where the law allows, use it for anything unlawful, or try to make Dex produce harmful content. We may suspend or end accounts that break these Terms.
7. Our content
Uncan, including its design, text, graphics and software, belongs to Appenstance, LLC and its licensors. We grant you a personal, non-transferable, non-exclusive license to use the app on Apple devices you own or control, for your own non-commercial use, under these Terms and Apple's Usage Rules. The data you enter stays yours. You let us use it only to provide the service to you.
8. Apple
These Terms are between you and Appenstance, LLC, not Apple. Apple isn't responsible for Uncan or its content, and has no obligation to provide maintenance or support for it. If Uncan fails to meet any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the maximum extent the law allows, Apple has no other warranty obligation for Uncan. Apple isn't responsible for any claims relating to Uncan, including product liability, legal or regulatory compliance, consumer protection or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm that you're not located in a country subject to a US government embargo and aren't on any US government list of prohibited or restricted parties.
9. Disclaimers
Uncan is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise that Uncan will be uninterrupted or error-free, or that your counters, streaks or savings estimates will be exact.
10. Limitation of liability
To the extent the law allows, we aren't liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or data. Our total liability for any claim relating to Uncan is limited to the amount you paid for Uncan in the 12 months before the claim. Some places don't allow these limits, so they may not fully apply to you.
11. Ending use
You can stop using Uncan and delete your account at any time. We may suspend or end your access if you break these Terms, or if we stop offering Uncan. If we stop offering it, we'll give you reasonable notice where we can.
12. Governing law and disputes
These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Wyoming, and you and we consent to their jurisdiction. There is no arbitration agreement in these Terms. This doesn't take away any rights you have under the consumer laws of the place where you live.
13. Changes to these Terms
We may update these Terms. We'll change the effective date above, and if a change is material we'll tell you in the app. If you keep using Uncan after a change takes effect, you accept the updated Terms.
